DETAILED WARRANTY TERMS Ver 1.1 – Dated 27th June 2019

  1. Under this policy (hereinafter “Warranty Policy”) the tronX things products / services shall have a limited warranty (hereinafter “Warranty”) against defects in materials and workmanship under normal use for a term varying between one to three years* (depends on the individual product/service and based on the applicable warranty at the time of purchase of the specific item/product/service) (hereinafter “Warranty Period”) beginning from the date of delivery of the Product/service to the purchaser (hereinafter “Customer”) applicable only to tronX things products (hereinafter “Device/Product”) purchased on or after 1st January, 2018. 
  2. The Warranty provides the Customer with certain basic legal rights. The Customer may additionally have other rights that may vary with countries, regions, provinces and states (hereinafter “Territory”). Other than as permitted by law, tronX things does not intend to exclude, limit or suspend any other rights that the Customer may have. For a more comprehensive understanding of the rights vested to the Customer, she/he is advised to consult the laws of the Territory. 
  3. It is further understood that tronX things is a company incorporated under the laws of India and is in the business of selling the Device/Product(s) either through its website, offline channel partner network/authorizes associates or other online market place from India. The country of sale, therefore, for all purposes shall be considered to be India unless otherwise held by law.
  4. This limited Warranty may, however, be transferred by the original Customer to any other individual to whom the Device/Product is resold by the original Customer during the Warranty Period, provided that at the time of warranty claim, the person to whom the Device/Product/Service is resold agrees to provide the original warranty documents, proof of purchase and all other such associated documents that may be needed to make a valid Warranty claim. tronX things, HOWEVER, RESERVES THE RIGHT TO REFUSE TO REPLACE OR CHARGE FOR THE SHIPMENT OF ANY Device/Product(S) IF IT IS RELOCATED FROM THE PLACE OF ITS ORIGINAL SHIPPING ADDRESS OR HANDLED / REMOVED BY AN UNAUTHORIZED PERSON OR TECHNICIAN. The Warranty Period available to individuals buying the Device/Product from an existing Customer of tronX things applies from the date of purchase of the Device/Product(s) by the original Customer from tronX things or its approved / authorized associates/network partners. The duration of Warranty will not be extended as a result of transfer of ownership. 
  5. The term “Device/Product/Service” unless expressly mentioned, shall, for the purposes of this warranty policy and unless mentioned otherwise, includes Smart switchboards, retrofit switchboards, IR Blaster, Smart Cloud hub, Smart bulb, Smart LED Strip, IP Cameras, PIR/motion sensor, Curtain controllers, tubular motors and such other Device/Products of tronX things included in the sales package/catalogue, published officially by tronX things from time to time.

WARRANTY COVER:

  1. Glass Touch Panel SSB (Smart Switchboards), RSSB (Retrofit SSB 7 Node), Smart Hub & IR Blaster: 24 Months from the date of purchase
  2. RSSB (Retrofit SSB 4 Node): 12 Months
  3. IR Remote: 6 Months from the date of purchase
  4. IP Cameras, Video Doorbell: 12 Months
  5. PIR Sensors: 12 Months from the date of purchase
  6. Curtain motors & Tubular motors: 24 Months from the date of purchase
  7. Smart Bulb & Smart LED strip: 36 Months from the date of purchase
  8. Sockets and Plugs: No warranty
  9. The warranty coverage for C, D, E, F and G will be provided by the respective 3rd party company as per the terms mentioned in the packaging box and by the respective company’s service center location and policy.
  10. The warranty periods mentioned above may vary from time to time for new purchases. The validity of warranty will be applicable as per policy applicable on the date of purchase.
  11. The Product/Service/Device Warranty Policy shall cover only those issues pertaining to the manufacturing and workmanship defects in the Device/Product(s) purchased by the Customer against a proper and valid invoice.
  12. Warranty applies only to the hardware Device/Product manufactured by or for tronX things that may be identified by the trademark, trade name, or logo of tronX things affixed to it. Warranty does not apply to any product, component or software of any party other than tronX things, whether or not packaged and sold with tronX things’s Device/Product(s). tronX things shall not be liable for any warranty provided by any third party to the Customer.
  13. Any software distributed by tronX things, including, but not limited to system software, is not covered under this Warranty Policy. Such software shall be governed by the respective licensing agreement of the software.

 

C. WARRANTY DOES NOT COVER
  1. tronX things does not warrant that the operation of the Device/Product will be uninterrupted or error free.
  2. There are Do’s and Don’t’s that are applicable for each product and the product is intended to be cared for and used as suggested. Any undue handling or damage caused due to such negligence of the customer, which is not in line with the suggestive measures, will not be covered warranty.
  3. Warranty does not apply at the occurrence of the following instances: 
    • To any of the consumable components of the Device/Product(s), such as the housing, housing color and other external attachments or the protective coatings that is susceptible to inevitable wear and tear over time, unless the failure has occurred due to a defect in design or the manufacture of the Device/Product. 
    • To cosmetic damage, including but not limited to scratches, dents, and any other cosmetic or other such physical damages. 
    • To damage caused by use of third-party products including but not limited to hardware damage caused by the installation and use of third party software and/or hardware products. 
    • to damage or failure to perform arising as a result of any “acts of God” or from any abuse, misuse, abnormal use or use in violation of any applicable standard, code or instructions for use including without limitation those contained in the industry and/or electrical standards for the relevant Territory or in this Warranty Policy and the other policies that may be uploaded on tronX things’s website. 
    • To damages caused by operating the Device/Product outside the permitted or intended use specified in the User’s Guide accompanying the Device/Product; 
    • To a Device/Product or any component or part of the Device/Product that has been opened or disassembled or modified from its original state by anyone, including the Customer or any other third party, other than a tronX things Authorised Service member (as defined in appropriate clause of the Warranty Policy) 
    • If the serial number on the Device/Product(s) has been removed or defaced or altered or if evidence suggests so
    • If there is deterioration of the Device/Product caused by regular wear and tear. 
    • If any defect arises due to the Internet modem, WiFi network or other third part accessory or system
    • Due to any upgrades made in the Device/Product’s software due to changes in WiFi or Internet connection/connecting device network parameters. 
    • Customer or any third party has so modified the Device/Product, either by reconfiguration or by replacing any part/software or ancillary part of the Device/Product with a part or ancillary parts/software that are not supplied or approved by tronX things, so as to alter the functionality of the Device/Product or any of its components. 
    • Customer is unable to provide valid proof of purchase, and details regarding the name and address of seller, date and place of purchase, Device/Product model and serial number.
    • Device/Product(s) purchased from unauthorized dealers or distributors or from any country other than the original country of purchase. 
    • Any kind of spillage of food or liquids on the Device/Product, or if the Device/Product gains damage due to exposure to prolonged and/or excessive moisture or dampness or subjected to extreme thermal environment conditions. 
    • Operating the Device/Product in a voltage supply or repeated unregulated voltages/spikes that is not conducive for the proper functioning of the Device/Product.
    • Operating the Device/Product in any other hostile environment that may prevent the Device/Product from performing optimally.
    • The Device/Product acquires or is subject to corrosion, rust or stains.
    • The Device/Product is repaired or attempted to be repaired by any party other than a tronX things authorized technician or personnel. 
    • Infestation caused by insects or due to contact with vermin.
    • Failure to conduct regular servicing or cleaning of the Device/Product or Subject to such usage for which the Device/Product is not designed. 
    • This warranty does not cover general Device/Product maintenance, demonstration, installation, routine servicing, calibration and customization of the Device/Product. 
    • Warranty does not cover any cracks on the glass, except if the glass was found to be cracked at the time of purchase, and the same was pointed out to tronX things at the time of delivery of the device/product by the customer, when a tronX authorized personnel opens the package box. If the package box is opened by any unauthorized person or the customer, without documented approval of tronX things or its associates, all the warranty claims will cease to apply. 
    • This Warranty does not apply if the Device/Product has been used for any purpose other than for personal use.
    • If the voltage in the phase or in the house, is either low or high and the components of the devices, get damaged by such occurrences. Voltage fluctuations can be momentary and also periodic and hence, repeated exposure of the devices to such uncorrected voltages, affects the functioning of the products and can also permanently damage the switchboards and the appliances connected to the switchboards. tronX things pvt. ltd. does not take any responsibility or accountability of damage either to the switchboards or to the devices, which occur due to such an occurrence. Customers are advised to rectify the frequency and voltages in their wirings in the houses/flats/villas/buildings immediately without delay.

 

  • WARRANTY CLAIM:

 

  • In case of a complaint Customer is advised to refer to the Terms and conditions mentioned in product packaging to ensure that all the correct operation procedures have been followed. The Customer can either visit tronX things’s website at (https://tronxthings.com/contact/) or write to the support team at ‘sales@things.smartron.com’ stating the problem. 

 

  • The Customer is advised to furnish to the support team at tronX things, with all the necessary and correct details regarding the problems she/he is facing with the Device/Product(s).

 

    • When contacting our service team, Customer is requested to provide details which may include among other things, full model number, details about purchase of extended warranty policy if applicable, serial number, date and proof of purchase and a brief description of the fault/query.
    • If the Device/Product is outside the Warranty Period, you should read about RMA procedures/policies provided in clause D.5 and D.6 of this Warranty Policy. 
    • A tronX things representative (hereinafter “Authorized Service Centre”) shall contact the Customer and attempt to diagnose and resolve the Customer’s problem through remote diagnostic tool, an email or a telephonic call. The Customer is required to clearly state the problem she/he might be facing with the Device/Product. The Authorized Service Centre will guide the Customer through a set of instructions depending on the nature of the complaint. Such instructions will be given with the intent of resolving the issue with the Device/Product and may also necessitate a photograph or a video of the Device/Product that the Authorised Service Centre may request the Customer to provide. As a part of the diagnosing procedure, Customer may be required to update their Application/Firmware and/or follow troubleshooting steps as may be suggested by the Authorised Service Centre. The Authorised Service Centre shall determine, at its sole discretion, whether the claim is eligible and/or valid. 
    • Based on the findings of the Authorised Service Centre, the Device/Product(s) may fall in one of following categories: i. Replaced by an equally functional Device/Product. ii. Provided out of warranty services using return material authorisation (“RMA”) services iii. In case there is a conflict between the Customer and tronX things a resolution process may be formulated using the RMA services. 
    • Out of warranty: tronX things will provide Out of Warranty repairs from its Authorised Service Centre for products which are not covered under the Warranty, he must pay for the out of warranty services including the expenses for all parts or ancillary parts necessary for the said out of warranty services, labour charges and any other associated expenses for the warranty service. Repair estimate for out of warranty service may be subject to change after receipt of Device/Product by the Authorised Service Centre. Authorised Service Centre will start repairing the Device/Product only when the customer has paid an initial advance amount for the warranty services. An estimated lead time will be intimated to the Customer at the time of submission of Device/Product. 
    • Resolution in case of conflicting diagnosis: 

      I. For complaints regarding a Device/Product the Customer may contact the Authorised Service Centre and follow the procedure as mentioned under clause D.1 and clause D.2 above. If the problem persists with the Device/Product and it is determined by the Authorised Service Centre that the problem is caused due to negligent handling by the Customer or any third party or for any other reason as mentioned under Clause C of this Warranty Policy, and the Customer disagrees to the same insisting that the defect with the Device/Product is caused due to a manufacturing or workmanship defect on the part of tronX things, a conflict may arise. 

      II. The Customer hereby agrees to provide any additional documentation and/or attaching the requisite proof as specified by Authorised Service Centre in order to evaluate the Warranty claim and determine Warranty eligibility. 

      III. The Authorised Service Centre will give the Customer a Workorder number and other associated details about the shipping information to the Authorised Service Center. The RMA number is provided to identify the complaint raised by the Customer and the Device/Product associated with the issue. 

      IV. The Authorised Service Centre’s decision on the applicability of warranty after such assessment will be considered final. 

      V. If the defect in the Device/Product is found to be caused by negligent handling by the Customer or a third party or for any other reason as mentioned under Clause C of this Warranty Policy, the Device/Product will not be eligible for Warranty and the Customer MUST bear all the risk, costs and expenses related to the servicing of the Device/Product, which may also include the cost of shipment or any other method that may be employed for the procurement of the defective Device/Product and the delivery of the serviced Device/Product. If the Customer decides to authorise a service which is not covered under the Warranty, he must pay for the out of warranty services including the expenses for all parts or ancillary parts necessary for the said out of warranty services, labour charges and any other associated expenses for the warranty service.

MISCELLANEOUS

  1. DISCLAIMER 

    a. tronX things disclaims any representation to the greatest extent permissible by law that it will provide the Customer with the replaced Device/Product complete within a certain number of days as may be requested by the Customer. tronX things representatives may provide estimates of the time required for Warranty Service, but the actual time required depends on the Customer’s geographic location, nature of the defect, availability of required spare parts or Device/Products at the tronX things Service Centre and other such extraneous factors beyond tronX things’s control. 

    b. tronX things disclaims all warranty services and all out of warranty services to Device/Product(s) purchased from unauthorised dealers or on warranty claims or service requests made from any country other than the original country of purchase. tronX things, further, reserves the right to refuse to replace any Device/Product(s) if it is relocated from the place of its original shipping address. 

    c. tronX things may upgrade the system software as part of normal Warranty Service, due to which data or applications present on the Device/Product, might be erased and some applications that were previously compatible with the Device/Product may cease to be compatible. tronX things will not be held liable for any damages, direct or consequential, for such upgrades. 

    d. This Warranty Policy is subject to change, from time to time, at the sole discretion of tronX things and the changes in the latest modified version of the same will be updated on tronX things’s website and will be binding on the Parties. 

    e. In order to receive the benefits of the Warranty, Customer shall provide the Authorised Service Centre access to the defective Device/Product for verification. Under no circumstances will tronX things be held liable for Device/Product malfunction. 

    f. tronX things will not be held liable for providing updates including but not limited to Application updates or for releasing new software, or firmware, or App updates. Such updates will be provided only at tronX things’s discretion and tronX things is not bound under this Warranty Policy and to the greatest extent permissible by law to be liable for providing or not providing the said updates. 

    2. LIMITATION OF LIABILITY 

    a. In no event shall tronX things be liable under this warranty for loss of profit, loss of anticipated profit or savings, loss of data, loss of use of the Device/Product or any associated equipment, or indirect, incidental or consequential losses or damages of any nature whatsoever to the fullest extent that those losses or damages can be disclaimed by law. 

    b. To the maximum extent permitted by law, and except as expressly set forth in the Warranty contained herein, tronX things makes no warranty or representation and there are no conditions, express or implied, statutory or otherwise, of any kind whatsoever with respect to the Device/Product, including but not limited to the merchantability of the Device/Product or its fitness for any particular purpose or use, design, condition, quality, or performance of the Device/Product, or workmanship of the Device/Product or the components contained therein. No reseller, agent, or employee of tronX things is authorized to make any modification, extension, or addition to this Warranty. Nothing contained in the associated documents on the website or otherwise shall be construed to create an express warranty of any kind whatsoever with respect to the Device/Product. tronX things shall not be liable for the breach of the express warranty, including incidental, special, consequential or similar damages, or loss of anticipated profits or benefits, or for damages arising from any tort (including negligence and contributory negligence) or fault committed by tronX things, its agents or employees, or for any breach of contract or for any claim brought against the Customer by any other party, to the greatest extent permissible under law. As for those warranties that cannot be disclaimed, tronX things limits the term of such warranty periods and remedies of such warranties to the term and duration as mentioned in the Warranty Policy for the repair or replacement services at tronX things’s option as described in the terms of this Warranty Policy. 

    c. This Warranty Policy does not affect your statutory rights as a consumer in any way. The Warranty is in addition to, and does not exclude or modify in any way the non-excludable statutory rights you may have under the laws of your Territory. Some jurisdictions disallow the limitation of damages or exclusions of implied or deemed warranties, so the above limitation or exclusions may not apply to you to the extent permissible under the law. 

    d. tronX things will remove all applications and data on the Device/Product once the same reaches the service centers of tronX things. tronX things disclaims any representation that it will be able to repair any Device/Product under this Warranty or make a Device/Product exchange without risk to or loss of programs or data. tronX things WILL NOT BE HELD LIABLE FOR ANY LOSS OF DATA. The Customer is advised to taking backups of any data stored on the Device/Product before sending the Device/Product to tronX things or to the Authorised Service Centre. It is further understood that Customer shall at all times keep a back up of all the necessary/confidential/ sensitive data even while the Device/Product is in use.


    3. SEVERABILITY 

    a. If any portion of this limited warranty is held illegal or unenforceable by reason of any law, such partial illegality or unenforceability shall not affect the enforceability for the remainder of this limited warranty which you acknowledge is and will always be construed to be limited by its terms or as limited as the law permits.

The Information and Communication revolution has brought enormous changes in the way we organize our lives, our economies, industries and institutions. These spectacular developments in modern times have undoubtedly enhanced the quality of our lives, but at the same time, have led to manifold problems including the problem of massive amount of hazardous waste and other waste generated from electric products. Such waste poses a serious threat to human health and environment. The issue of proper management of such hazardous E-waste is therefore critical to the protection of livelihood, health and environment.

To deal with this ever-rising problem of E-waste, the government of India, through its Ministry of Environment and Forest, formulated the E-waste (Management and Handling) Rules in 2016.

The Basel Convention defines wastes as :

“Substances or objects, which are disposed off or are intended to be disposed off, or are required to be disposed off by the provisions of national laws”.

E-waste has been defined as :

“Waste electrical and electronic equipment, whole or in part or rejects from their manufacturing and repair process, which are intended to be discarded”.

Whereas, electrical and electronic equipment has been defined as “Equipment which is dependent on electrical currents or electro-magnetic fields to fully functional”.

Like hazardous waste, the problem of E-waste has become an immediate and long-term concern as its unregulated accumulation and recycling can lead to major environmental problems endangering human health. This calls for an urgent need for E-waste Management so as to preserve the ecological balance and reduce landfills. Recycling end-of-life products is vital if we are to save resources and minimize waste.

As an environmentally conscious organisation, tronX things has initiated various activities to promote E-waste recycling.

Why Recycle?

Conserve Resources

Creation requires raw resources. But when we recycle, extant material is put to use. Recycling saves this extraction of the fresh raw resources, and revives the existing ones that are no longer of use. This way there is lesser exploitation and more conservation of natural resources.

Save Energy

Each time we recycle a product, it requires lesser energy than producing a new one from the scratch. The considerable difference in manufacturing time is a result of skipping the usual process of extraction of raw material, its transportation, refining etc., which is way more than having a market ready product that to have a raw material ready for production.

Prevent Pollution

Production and disposal of products require a great deal of extraction, refining, processing and dumping of material, which have larger impact on the environment. By recycling, we cut down the pollution of air, water and land, thus reducing the greenhouse gas emission and avoiding any contribution to global warming.

Don’ts for E-waste !
  • The product should not be opened/dismantled by the user himself/herself, but only by authorized service personnel.
  • The product is not meant for re-sale to any unauthorized agencies/scrap dealer.
  • The product is not meant for mixing into household waste stream.
  • Do not keep any replaced spare part(s) from the product in exposed area.
